Orange Park PIP Lawyers

Although not all of them will result in serious injuries, most drivers will be involved in a car accident at some point. In Orange Park, as throughout the rest of Florida, most traffic accidents are governed by no-fault auto insurance laws. It is important that all motorists are familiar with these laws, so they are prepared for whatever may happen. If you have been injured in a crash, our Orange Park PIP lawyers can help you claim the maximum benefits you are entitled to.

What Does PIP Cover?

Under the no-fault laws of the state, all motorists must purchase a minimum of $10,000 personal injury protection (PIP) coverage. After a crash, drivers can then file a claim with their own insurance company to recover PIP benefits. Due to the fact that PIP is considered no-fault, you can claim these benefits even if you caused the accident. Under the law, you may be able to claim the following:

  • A maximum of $10,000 to cover 80 percent of your medical costs
  • A maximum of $10,000 to cover 60 percent of your lost income if you cannot return to work
  • A maximum of $5,000 in death benefits, if the accident was fatal
  • Transportation costs for going to and from doctors’ appointments

If you do not suffer from an emergency medical condition caused by the accident, you can only claim a maximum of $2,500 in PIP benefits. To be eligible for the benefits available when you suffer from an emergency medical condition, you must have a licensed medical professional confirm that you suffered an injury that resulted in the loss of a bodily function, or that was life-threatening.

Who is Covered by PIP?

If you are hurt in your vehicle during an accident, you can claim PIP to help cover the cost of your injuries. However, certain other people can also claim these benefits. These individuals include:

  • Family members who live with you, but only if they do not own their own vehicle
  • Anyone operating the car without consent from the owner
  • Passengers who were in your vehicle and became hurt during the accident
  • Bystanders who were hit by your car and who sustained bodily injury, such as pedestrians and bicyclists

Regardless of who qualifies for PIP benefits, they are rarely easy to obtain. Insurance companies prioritize their own profits and bottom line over the health of accident victims. A lawyer will negotiate on your behalf and communicate with the insurer so you receive the full compensation you are entitled to.
