Orlando Personal Injury Lawyers

Accidents happen in Orlando every day and when they do, people suffer very serious injuries. As they recover, they incur high medical bills, lost income if they cannot return to work, and endure extreme pain and suffering. If you have been in an accident and someone else was to blame, you can file a personal injury claim against them to recover your losses. These claims are not easy to file, though. Our Orlando personal injury lawyers will assist with the claims process and help you obtain the full and fair settlement you are entitled to.

Practice Areas

Accidents happen in a number of different ways and so, there are many different areas of personal injury law. Some of the most common types of personal injury practice areas are as follows:

  • Car accidents
  • Commercial truck accidents
  • Cruise ship accidents
  • Medical malpractice
  • Motorcycle and ATV accidents
  • Nursing home abuse and neglect
  • Pedestrian accidents
  • Premises liability accidents

The above are just a few types of accident cases our personal injury lawyer can help with.

Time Limits on Personal Injury Claims

Although you can file a claim against a negligent or careless party after being hurt, you only have a limited amount of time to do so. The majority of personal injury cases in Orlando have a statute of limitations, or time limit, of four years from the date of your accident. There are some exceptions to this.

If you need to file a medical malpractice claim or wrongful death claim, you only have two years from the date of the accident to start the legal action. Also, if you are filing a claim based on contract law instead of tort law, such as after a car accident, the statute of limitations is extended to five years from the date of an accident.

Damages Available in a Personal Injury Claim

No one can determine how much you may receive in a personal injury case without first fully reviewing the facts of your case. Still, there are some types of damages, or financial compensation, that are more common than others. These are as follows:

  • Past and future medical expenses
  • Lost income and loss of future earning capacity if you cannot return to the same line of work
  • Pain and suffering
  • Permanent scarring and/or disfigurement
  • Loss of companionship and support
  • Burial and funeral expenses, if filing a wrongful death claim

Generally speaking, there are no caps placed on the damages available in a Florida personal injury claim. However, if you are filing a medical malpractice claim, damages for pain and suffering are capped at $500,000.
