Naples PIP Lawyers

Florida is one of many states that follows a no-fault auto insurance system. Under the no-fault system, drivers must purchase personal injury protection (PIP). PIP holds many benefits for drivers, but that does not mean that claiming this type of coverage is easy. Our Naples PIP lawyers can review the facts of your case, determine the options available for claiming compensation, and help you claim the full PIP benefits you deserve.

Why Does Florida Require PIP?

Today, many states throughout the nation follow no-fault auto insurance law. Florida, though, was the second state in the country to adopt these laws. At the time, the Florida Senate argued that enacting the law would allow injured accident victims to claim the full compensation they need more quickly after a crash. There are other benefits to PIP benefits, as well. These include:

  • PIP is a no-fault system, so even when a motorist was wholly or partly to blame for an accident, they can still receive compensation for their medical expenses and a portion of their lost income
  • Reducing the backlog of the civil courts, as PIP benefits greatly reduce the number of lawsuits filed
  • Lower the auto insurance premiums drivers have to pay

Even though lawmakers may have had good intentions when creating the law, it does not always hold the benefits it was originally thought it would. Still, trying to obtain PIP benefits is not easy. It is often the only way for people to obtain the compensation they need after a crash.

Coverage Available Under PIP

There are many different types of coverage accident victims can obtain from PIP after a crash. These are as follows:

  • Up to $10,000 that can cover 80 percent of medical costs
  • Up to $10,000 that can cover 60 percent of lost income
  • Up to $5,000 in death benefits
  • The cost of transportation to and from doctor’s appointments

Emergency Medical Conditions

Unfortunately, not all accident victims can receive the full $10,000 available in PIP benefits. In order to be eligible, an injured individual must seek treatment from a licensed medical professional. If the medical professional determines that the patient has suffered a serious injury that results in a loss of bodily function, or that is life-threatening, the individual can recover up to $10,000 in PIP benefits.
